Acknowledgment of Risk

I, the undersigned Guardian, acknowledge that participation in gym activities, fitness training, outdoor activities, workshops, and excursions involves inherent risks, including but not limited to:
- Physical injury (minor or serious)
- Falls, collisions, or equipment-related injuries
- Exposure to outdoor elements
- Accidents during transport or off-site activities
- Illness or unforeseen incidents
I understand that while reasonable precautions will be taken, risks cannot be completely eliminated.

Voluntary Participation

I confirm that my Child is voluntarily participating in all activities offered by WhatTheFit4 GYm, including but not limited to:
- Gym and fitness sessions
- Skills development programs
- Team activities and challenges
- Workshops and practical life-skills training
- Excursions, outings, and off-site events
I understand that participation is optional and I accept all associated risks.

Medical Fitness

I confirm that my Child is physically and medically fit to participate in physical activities unless otherwise disclosed in writing above. I agree to inform WhatTheFit4 Gym of any medical conditions, allergies, behavioral concerns, or special requirements prior to participation.

I authorize WhatTheFit4 Gym to obtain emergency medical treatment for my Child if necessary and agree that I will be responsible for any associated medical costs.

Excursion's & Off Site Activities

I acknowledge that certain programs may include excursions, outings, transport, and activities conducted off the gym premises.

I expressly acknowledge and accept that:
- My Child may travel in private or third-party transport arranged by WhatTheFit4 Gym
- Activities may take place in public or outdoor environments
- There is a possibility of injury, separation, getting lost, or other unforeseen incidents
I hereby release and indemnify WhatTheFit4 gym from any liability arising from incidents occurring during transport, excursions, or off-site activities, including but not limited to injury, loss, disappearance, or damage to personal property.

Mission Ready Program Uniform

Mandatory Uniform: All participants in the Mission Ready Program are required to wear the official program uniform during training and related activities. The uniform is specifically designed to protect the child from potential injuries and to safeguard the child’s personal clothing.
Separate Cost: The uniform is not included in the monthly program fee and will be invoiced separately. Families are responsible for ensuring their child has the correct uniform at all times.
Rank Advancement Responsibilities: Once a participant has progressed to Rank PRIVATE, they will be responsible for sewing on their own stripes, badges, and insignia earned throughout the program.

Indemnity & Hold Harmless

To the fullest extent permitted by law, I hereby indemnify, defend, and hold harmless WhatTheFit4 Gym from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses (including legal fees) arising from or related to:
- Injury, disability, or death of my Child
- Loss or damage to personal belongings
- Incidents occurring during activities, excursions, or travel
- Any negligence not amounting to gross negligence under applicable law
This indemnity applies whether claims are brought by me, my Child, or any third party.

Personal Property

I acknowledge that WhatTheFit4 Gym is not responsible for the loss, theft, or damage of any personal belongings brought onto the premises or taken on excursions.

Behavior & Safety Compliance

I understand that all participants are expected to follow safety instructions and behavioral guidelines. WhatTheFit4 Gym reserves the right to remove any child from activities if their behavior is deemed unsafe or disruptive, without refund where applicable.

Cancellation & Notice Period

I acknowledge and agree that enrolment in any WhatTheFit4 Gym children’s program requires one full calendar month’s written notice to terminate participation.
- Notice must be provided in writing via email or signed written communication. (www.whatthefit4gym.co.za)
- Notice will run from the 1st day of the following calendar month, regardless of the date submitted.
- Fees remain payable in full during the notice period.
- Failure to provide proper notice will result in fees being charged in lieu of notice.
This clause applies to all WhatTheFit4 Gym youth programs unless otherwise stated in writing.

Photography & Media Consent (OPTIONAL)

WhatTheFit4 Gym has in-house photographers
- WhatTheFit4 Gym has in-house photographers.
- From time to time, photography and video footage may be taken within the gym for marketing and community purposes. These may be used on digital platforms, print materials, and other promotional media. By signing this agreement, you consent to such use.
- Client acknowledges and accepts in-house photography for the use of professional marketing. This indemnification shall include, but not be limited to, claims for invasion of privacy, defamation, or violation of any other right or interest.
- Should you wish not to appear in marketing material, you may notify the gym in writing via email and reasonable steps will be taken to exclude your image from new materials.

Limitation Of Liability

I acknowledge that WhatTheFit4 Gym will take reasonable care in supervising activities but cannot guarantee the prevention of accidents or injuries. I accept that participation is undertaken at my own risk on behalf of my Child.

Legal Capacity

I confirm that I am the lawful parent or legal guardian of the Child and have full authority to sign this Agreement. I understand the contents of this document and sign it freely and voluntarily.

Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
